DWI: Overview

This overview outlines the escalating legal classifications and penalties for Driving While Intoxicated (DWI) in Missouri as of 2025-2026. Each subsequent offense increases the severity of the charge, mandatory jail time, potential fines, and prison time.

The Escalation of Missouri DWI Offenses

1. First-Time Offender

  1. Classification: Class B Misdemeanor.
  2. Standard Penalty: Up to 6 months in jail and a fine of up to $1,000.
  3. Mandatory “Shock” Jail: While often 0 days for low BAC , a BAC of 0.15–0.20 requires 48 hours, and a BAC over 0.20 requires 5 days of mandatory jail time.

2. Prior Offender

  • Definition: One prior intoxication-related conviction within five years of the current offense.
  • Classification: Class A Misdemeanor.
  • Standard Penalty: Up to 1 year in jail and a fine of up to $2,000.
  • Mandatory Minimum: Must serve 10 days in jail before becoming eligible for probation.
  • Alternatives: The jail time may be waived in exchange for 30 days (240 hours) of community service or successful completion of a DWI Court program.

3. Persistent Offender (Crossing into Felony Territory)

  • Definition: Two or more prior intoxication-related convictions (no time limit applies to these priors).
  • Classification: Class E Felony.
  • Standard Penalty: Up to 4 years in prison and a fine of up to $10,000.
  • Mandatory Minimum: Must serve 30 days in jail before becoming eligible for probation.
  • Alternatives: The jail time may be waived in exchange for 60 days (480 hours) of community service.

4. Aggravated Offender

  • Definition: Three or more prior intoxication-related convictions.
  • Classification: Class D Felony.
  • Standard Penalty: Up to 7 years in prison and a fine of up to $10,000.
  • Mandatory Minimum: Must serve 60 days in jail. At this level, the option to perform community service to avoid jail is generally removed by statute.

5. Chronic Offender

  • Definition: Four or more prior intoxication-related convictions.
  • Classification: Class C Felony.
    Standard Penalty: 3 to 10 years in prison and a fine of up to $10,000.
  • Mandatory Minimum: Must serve 2 years in prison before becoming eligible for probation or parole.

6. Habitual Offender

  • Definition: Five or more prior intoxication-related convictions.
  • Classification: Class B Felony.
  • Standard Penalty: 5 to 15 years in prison.
  • Mandatory Minimum: Must serve 2 years in prison before becoming eligible for probation or parole.
