“Restitution” is defined as “money payments to make a victim whole.” This might be for damages property, medical payments, etc. It is not a “fine” for punishment.
FYI, here is a link the St. Francois County Crime Victim Guide to Restitution.
All Restitution payments are through the Prosecutor’s Office. Clients do not pay the victims directly or through your own attorney. And the Prosecutor’s Office has one-time $75 fee to accept payments and then pay the victims. This one-time $75 is the same for any restitution amount. I don’t think it is called a “set-up fee” but that is kind of what it is. And it must be paid with a separate money order or cashier’s check.
For example, if you damaged a victim’s property and that damage was $250. You would need to get a $75 money order (or cashier check) for the Prosecutor to “set up” the restitution account and then you could pay remaining money orders (or cashier’s check(s)) the Restitution over time to the full $250. So, your total paid would be $325 ($75 set-up fee + $250 restitution).
To illustrate, you could pay two money orders to start: One for $75 for the one-time set up fee and on for $50 for restitution [total restitution paid = $50]; pay another $50 money order a month later [total restitution paid = $100], another $50 money order two weeks later [total restitution paid = $150], another $20 money order the next month [total restitution paid = $175], and another $80 money order two months after that [total restitution paid = $250]. Again, the total you would have paid would be $325 ($75 set-up fee + $250 restitution).
